Karim Khan suspended: an unprecedented crisis shakes the International Criminal Court

The International Criminal Court (ICC) is going through one of the most serious institutional crises in its history. Its chief prosecutor, Karim Khan, has been suspended from his duties pending a final decision by the institution’s 125 member states, following a lengthy investigation into allegations of inappropriate sexual behavior.

This decision marks a major turning point for the international jurisdiction based in The Hague. Never before has an ICC prosecutor been the subject of such disciplinary proceedings leading to an official suspension. The case comes at a particularly sensitive time, with the Court at the center of numerous geopolitical controversies linked to conflicts in Ukraine, Sudan and, above all, Gaza.

According to several corroborating sources, the investigation, which lasted nearly eighteen months, examined allegations made by a female court employee who claims to have been the victim of non-consensual sexual behavior. Karim Khan has always rejected these accusations, denouncing a procedure he considers unfair and groundless.

However, the suspension does not constitute a conviction. The ICC’s governing bodies emphasize that this is a precautionary measure pending a final decision by the Assembly of States Parties. The Assembly is due to meet shortly in an extraordinary session to rule on whether to maintain or permanently dismiss the British prosecutor.

The matter is all the more delicate as it affects a figure who has become one of the best-known faces of international justice. Since taking office in 2021, Karim Khan has overseen several major investigations, notably requesting arrest warrants for Israeli Prime Minister Benjamin Netanyahu as well as several Hamas leaders for alleged crimes committed in the context of the Gaza conflict. These decisions have placed the ICC at the heart of intense diplomatic clashes between major powers.

Some observers believe that this suspension risks temporarily affecting the institution’s credibility and effectiveness. Others argue, on the contrary, that the Court’s ability to investigate its own officials is a demonstration of its independence and its commitment to the principles of accountability and transparency.

The procedure is now expected to enter a political phase. Member states will have to review the findings of the disciplinary bodies and decide whether Karim Khan can resume his duties or whether he must be permanently removed from the head of the ICC prosecution.

Whatever the outcome of the case, this affair will leave a lasting mark on the history of the International Criminal Court and is already raising major questions about its governance, its internal functioning and its ability to preserve its moral authority in an increasingly polarized international context.
